Embodied Wholeness Path™ — Service Agreement, Liability Waiver & Terms of Purchase

By checking the box at checkout, you (“Client”) agree to the following terms for participation in The Embodied Wholeness Path™ Personal Mentorship with Takiyah Gettys, Incorporated (“Coach”):

1. Services Provided

The Embodied Wholeness Path™ is a private mentorship combining personalized NeuroSomatic Recode™, somatic integration, and embodiment coaching to support nervous system regulation, confidence, and aligned creation.

Services include:

Six (6) 60–90 minute 1:1 Coaching Sessions (bi-weekly)
Weekly text or voice check-ins for accountability and integration
Access to personalized digital tools, rituals, and practices curated for your goals

These services are educational and transformational, not medical treatment or psychotherapy. No medical, psychological, or financial outcomes are guaranteed.

2. Program Term & Payment

This Agreement begins on the purchase date and covers the agreed 3-month term.
Program fees are due in full or via an approved payment plan prior to the first session.

All payments are non-refundable and non-transferable.
If Client withdraws, misses sessions, or does not complete the program for any reason, the full balance remains due.

Missed, failed, or late payments may result in suspension of access and forfeiture of bonuses.
Client acknowledges responsibility for completing all payments regardless of participation level.

3. Scheduling & Cancellations

Sessions are scheduled in advance. A minimum of 24 hours’ notice is required to reschedule.
Missed sessions or cancellations without notice are forfeited and cannot be made up.
Emergencies are considered on a case-by-case basis.

4. Client Responsibilities

Attend sessions on time, in a private, quiet, and stationary space (no driving or multitasking).
Engage respectfully and complete agreed-upon integration practices.
Follow all safety guidance for breathwork, somatic, and movement practices.
Communicate promptly regarding scheduling or support needs.

Transformation requires your full participation and commitment.

5. Health, Safety & Contraindications for Breathwork & Movement

Participation is voluntary and self-paced. Breathwork and movement may produce physical or emotional sensations (e.g., tingling, lightheadedness, emotional release). You agree to listen to your body and modify, pause, or stop as needed.

Consult your licensed healthcare provider before participating if you have or suspect:

Cardiovascular or respiratory conditions (e.g., uncontrolled hypertension, cardiac events, unmanaged asthma/COPD)
Epilepsy or seizure history, significant neurological conditions
Glaucoma, retinal detachment, recent surgery, orthopedic instability
Pregnancy or postpartum (especially high-risk)
Severe psychiatric conditions (e.g., psychosis) or current substance use concerns

You are solely responsible for your health and safety decisions during and after participation.

6. Medical Disclaimer

These services are not medical advice, diagnosis, or treatment.
Always seek the guidance of a qualified healthcare provider regarding any medical or mental health condition.

7. Confidentiality & Intellectual Property

All personal information shared is confidential, except as required by law.
All content, recordings, and methods are the intellectual property of Takiyah Gettys, Incorporated and are for personal, non-commercial use only.

Recording, distribution, or teaching of materials without written permission is strictly prohibited.

8. Assumption of Risk & Release of Liability

You understand that breathwork, movement, and coaching inherently involve physical, emotional, and psychological risk.
You voluntarily participate and assume full responsibility for your experience.

To the fullest extent permitted by law, you release and hold harmless Takiyah Gettys, Incorporated, its owners, contractors, and affiliates from any and all claims arising from participation, except in cases of gross negligence or intentional misconduct.

You agree to indemnify and defend the Coach against any third-party claims resulting from your actions or violation of this Agreement.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, with exclusive jurisdiction in Florida.

Acknowledgment

By completing your purchase, you confirm you have read, understood, and voluntarily agree to all terms of this Agreement, including the Breathwork and Movement Waiver above.
